Terms of Service

1. Introduction

Welcome to SmartSVG.ai (“SmartSVG.ai”, “Company”, “we”, “us”, or “our”). SmartSVG.ai is a Canadian Software-as-a-Service platform that provides AI-powered image-to-SVG conversion tools accessible through an online interface (the “Service”).

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service.

These Terms apply to all users worldwide, without limitation based on geographic location.

2. Eligibility and Account Registration

To access the Service, including free credits, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep such information updated.

You must be at least eighteen (18) years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. SmartSVG.ai shall not be liable for any loss or damage arising from unauthorized use of your account.

We reserve the right to suspend or terminate accounts at our sole discretion, including in cases of suspected abuse, violation of these Terms, or unlawful activity.

3. Description of the Service and Credits

SmartSVG.ai provides automated artificial intelligence technology that converts user-uploaded images into SVG vector format and generates SVG vector images from text prompts.

Upon account creation, users receive thirty (30) free credits, refreshed every seven (7) days. SmartSVG.ai may, at its discretion, modify the free credit allotment or refresh schedule at any time without prior notice.

The Service offers three types of paid credit access: (a) monthly subscription plans (Maker and Creator), (b) one-time credit packs (pay-as-you-go), and (c) the Studio Team Plan for shared team use. Monthly subscription credits refresh at the start of each billing period. Creator plan subscribers may accumulate unused credits across billing periods, up to a maximum of 3,000 credits. Maker plan subscribers' unused credits do not carry over to the next billing period. One-time pack credits never expire.

Credits have no monetary value and are non-refundable except where required by applicable law. Credits are non-transferable between individual accounts, except as expressly permitted under a Studio Team Plan as described in Section 15. SmartSVG.ai reserves the right to modify pricing, features, credit allocations, and plan structures at any time without prior notice.

4. Artificial Intelligence Disclaimer

The Service relies on automated artificial intelligence systems to generate SVG outputs. You acknowledge and agree that AI-generated results may be inaccurate, incomplete, or unsuitable for specific purposes.

SmartSVG.ai does not guarantee the quality, accuracy, legality, or fitness of any generated output for commercial or professional use. All outputs are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied.

To the fullest extent permitted by law, SmartSVG.ai disclaims all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

5. User Content and Intellectual Property Responsibility

You retain ownership of any images you upload to the Service. However, by uploading content, you represent and warrant that you have all necessary rights, licenses, and permissions to use and convert the content.

You agree not to upload any content that infringes copyright, trademark, trade secret, or other intellectual property rights of any third party.

SmartSVG.ai does not review, verify, or monitor the legality of user-uploaded content. You acknowledge that you are solely responsible for any legal consequences arising from your uploads and generated outputs.

You agree to indemnify, defend, and hold harmless SmartSVG.ai, its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, your uploaded content, or your violation of these Terms.

6. Copyright Compliance

SmartSVG.ai respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that material available through the Service infringes your copyright, you may submit a written notice including sufficient detail to identify the allegedly infringing content.

We reserve the right to remove content and terminate accounts of repeat infringers at our sole discretion.

7. Payments, Billing, and Subscriptions

Payments for paid credits and plans are processed securely through Stripe. SmartSVG.ai does not store or process payment card information directly.

You agree that SmartSVG.ai is not responsible for payment processor errors, interruptions, delays, chargebacks, or fraudulent transactions.

Monthly subscription plans (Maker and Creator) are billed automatically at the start of each billing period. You may cancel your subscription at any time from your dashboard. Upon cancellation, your subscription remains active until the end of the current billing period; no partial refunds are issued for unused time within the current period. Credits allocated for the current period remain available until the end of that period.

If a subscription payment fails, SmartSVG.ai may suspend access to subscription features. Stripe may automatically retry failed payments. Accounts with payment failures are notified by email.

All one-time pack purchases are final. Subscription purchases are non-refundable except where required by applicable consumer protection laws. In the event of a chargeback or payment dispute initiated without valid cause, SmartSVG.ai reserves the right to suspend the associated account and pursue recovery of fees.

8. Data Retention

Users may access their generation history within their account. Generated files and related history are stored for up to six (6) months from the date of creation and are automatically deleted thereafter.

Users are solely responsible for downloading and backing up their files prior to deletion. SmartSVG.ai shall not be liable for any loss of data following automatic deletion.

Account information is retained until the user deletes their account or requests deletion, subject to legal retention requirements.

9. Acceptable Use

You agree not to use the Service for any unlawful purpose or in violation of any applicable laws or regulations. You further agree not to upload malicious software, attempt reverse engineering, overload infrastructure, scrape the Service, or otherwise interfere with the operation or security of the platform.

SmartSVG.ai reserves the right to investigate suspected violations and to suspend or permanently terminate accounts without notice.

10. Limitation of Liability

To the maximum extent permitted by law, SmartSVG.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunities, or data.

In no event shall SmartSVG.ai's total aggregate liability exceed the greater of (a) the total amount paid by you in the three (3) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

11. Arbitration and Class Action Waiver

Where permitted by law, any dispute arising under these Terms shall be resolved through binding arbitration conducted in Canada. You agree to waive any right to participate in class action proceedings and agree that claims shall be brought solely on an individual basis.

12. Prohibited Content – Explicit and Sexual Material

You may not upload, convert, generate, or process any content that:

• Contains pornography or sexually explicit material;
• Depicts nudity intended for sexual arousal or exploitation;
• Involves minors in any sexual or suggestive context;
• Contains sexual violence, exploitation, or abuse;
• Violates applicable obscenity laws;
• Is illegal in the jurisdiction where you reside or access the Service.

SmartSVG.ai maintains a strict zero-tolerance policy toward child sexual abuse material (CSAM). Any suspected content of this nature will be immediately reported to appropriate law enforcement authorities without prior notice.

We reserve the right to immediately suspend or permanently terminate any account involved in uploading or processing prohibited sexual content.

13. Referral Program

SmartSVG.ai may offer a referral program allowing registered users to earn credits by inviting others to create an account and make a purchase (“Referral Program”).

Referral rewards are subject to the following conditions:

• Rewards are credited only when the referred user completes their first paid purchase through SmartSVG.ai;
• The standard referral reward is ten percent (10%) of the credits included in the referred user's first purchase. For Studio Team Plan purchases, the referral reward rate is five percent (5%) of the credits purchased;
• If the referring user is a member of a Studio Team at the time the reward is issued, referral credits are credited to the Team Owner's shared credit pool rather than to the referring member's personal account;
• Each referred user may only be attributed to one referrer;
• Self-referral (creating secondary accounts to refer yourself) is strictly prohibited;
• Spam, misleading advertising, or any abusive distribution of referral links is prohibited;
• Referral credits have no monetary value, are non-transferable, and are non-refundable;
• SmartSVG.ai reserves the right to withhold, revoke, or adjust referral credits if fraud or abuse is detected;
• SmartSVG.ai reserves the right to modify, suspend, or terminate the Referral Program at any time without prior notice.

Participation in the Referral Program constitutes acceptance of these conditions.

15. Studio Team Plan

SmartSVG.ai offers a Studio Team Plan (“Studio”) that allows one account holder (“Team Owner”) to invite up to a specified number of other registered users (“Team Members”) to share a common credit pool. Studio is a monthly subscription at a flat rate that includes a shared credit pool refreshed each billing period.

The Studio plan is subject to the following conditions:

• Only the Team Owner subscribes and manages billing. All conversions and generations performed by any Team Member are deducted from the shared credit pool;
• The Team Owner is solely responsible for all activity conducted by Team Members under their shared pool;
• The Team Owner may remove Team Members at any time. Removed members immediately lose access to the shared credit pool;
• Team Members may leave a team at any time from their dashboard;
• If the Team Owner's account is suspended or deleted, all Team Members immediately lose access to the shared credit pool. No refund is issued for unused shared credits;
• Credits shared within a Studio plan are non-transferable outside that team and retain no monetary value;
• SmartSVG.ai reserves the right to modify, suspend, or discontinue the Studio Team Plan at any time without prior notice.

By inviting Team Members or accepting an invitation, both the Team Owner and Team Members agree to these conditions.

16. AI Image Generation Feature

SmartSVG.ai offers an AI image generation feature (“Generate”) that allows users to create vector images from text prompts using third-party AI technology.

The Generate feature is governed by the following conditions:

• The Generate feature draws from the same unified credit pool as image conversion. Generation costs 10 credits per image; conversion costs 5 credits per image;
• With a Studio Team Plan, Generate usage by any team member is deducted from the shared team credit pool;
• Free promotional credits may be granted at SmartSVG.ai's discretion and may be subject to weekly limits and expiry;
• You may not use the Generate feature to create content that violates Section 12 (Prohibited Content) of these Terms;
• You agree not to submit prompts that are defamatory, hateful, harassing, violent, or that infringe on any third-party rights, including trademark, copyright, or rights of publicity;
• SmartSVG.ai does not review prompts in real time. You are solely responsible for the prompts you submit and the outputs you receive;
• SmartSVG.ai makes no guarantee that outputs will be unique, original, or free from similarity to existing works. You assume all risk in using AI-generated images for commercial or public purposes.

By using the Generate feature, you agree to all conditions set out in this section.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the Province in which SmartSVG.ai is registered, without regard to conflict of law principles.
